2、共和国建筑法及其他有关法律、法规，及遵循平等、自愿、公平和诚实信用的原则；兹以上述各点和契约所载条款为约因，双方就本工程施工事项协商一致，订立本合同。WHEREAS party A , though bidding procedure and specialists review, is ready to contract the project of high pressure gas pipeline engineering (hereinafter referenced to as project ) to party B for execution and completion;WHE
3、REAS party B possess the qualification of construction, accept the conditions of bidding and is ready to contract the project execution and make completion pursuant to the stipulations of contract.WHEREAS physical circumstances of this project; the stipulations of LAW OF CONTRACT, LAW OF CONSTRUCTIO
4、N and other related laws and regulations, in addition to the principles of equality, voluntary, fairness and honesty.NOW THEREFORE, in consideration of the premises and the covenants herein, terms and provisions contained, the parties hereto make mutual agreement on this project as follows:1. 工程概况 P

13、romises and undertaking6.1 承包人向发包人承诺将按照合同约定进行施工、竣工并在质量保修期内承担工程质量保修责任。Contractor make promises and undertaking hereby that it shall in accordance with the stipulations hereof conduct the execution, completion and assume the responsibilities of maintenance within the period of quality warranty.6.2 发包人

18、 the as built drawings. 二、 双方一般权利和义务 General Rights and Responsibilities of Parties hereto5发包人责任 Employers Responsibilities 51发包人应按约定的时间和要求完成以下工作：Employer should as per the time limited and requirements complete following works:（1）施工场地具备施工条件的要求及完成的时间：开工前七天内使施工场地具备施工条件。（2）将施工所需的水、电、电讯线路接至施工场地，配合承包人办理
19、其相关施工手续。 Connecting the pipelines of water, electricity and communication, which are necessary to construction to the site and make cooperation with contractor to conduct the execution procedures. （3）配合承包方完成施工场地公共道路的通行，达到运输条件。Cooperation with contactor in accomplishment of the access to public road

21、 days prior to commencement complete the procedures of Execution License, past rights of road, railroad and river in addition to permissions of temporary land use and explosion work. 6承包人的责任 Contractors Responsibilities 承包人应按约定时间和要求，完成以下工作：Contactor should as per the time limited and requirement com
22、plete following works:（1）每月25日前，向发包人和监理工程师提供月施工计划及进度报表。Prior to 25th each month provide the monthly schedule and rate progress to employer and supervision engineer. （2）承包方应当遵守有关主管部门对施工场地交通、环保、安全生产等管理规定并承担施工中全部安全责任。Contractor should comply with the competent authoritys management regulations on the c
23、ommunication, environmental protection and safety production on the site and assume all safety responsibilities during construction.（3）负责管材现场装卸运输、二次倒运，施工降排水；施工用材料设备采购（发包人供应项目除外）；系统设施的检验、试压和配合调试。竣工后，负责竣工资料（含竣工图）的整理，向发包人提供竣工资料6套。Responsible for the loading / transportation of pipes on sit, transfer tr
24、ansit, drainage, purchase of materials / equipments ( except to the items which are provided by employer ), the inspection, pressure test and debugging cooperation. After completion of Works responsible for the preparation of completement data including the as built drawings and submit six copies of
25、 completion data to employer. （4）除管材、弯管外，其他工程相关的材料均由承包方承担。Other materials concerned project except pipes and elbow pipe should be borne by contractor. 三、施工组织设计和工期 Execution Organization Design and Works Period 7进度计划 Progress Schedule承包人提供施工组织设计（施工方案）和进度计划的时间：开工前10日提供。工程师确认的时间：开工前5日。Contractor should
26、 prior to ten days submit execution organization design ( project schedule ) and the rate progress for which, prior to five days by engineers confirmation. 8工期延误 Delay of Work Period 双方约定工期顺延的其他情况：（1）、未按合同约定时间拨付工程款；（2）未及时完成施工许可手续；（3）工程量增加，工程设计变更、自然不可抗力；（4）应当由发包方供应的材料未及时到位。The other circumstances whi

28、s which should be provided by employer to the site in time. 四、质量与验收 Quality and Acceptance隐蔽工程和中间验收 Concealed works and intermediate acceptance双方约定中间验收部位：管道焊接、防腐补口、管道试压、吹扫、干燥、管沟开挖及回填，阴极保护、三桩埋设、水工保护、穿越工程、隐蔽工程。The parts of intermediate acceptance as agreed by parties hereto are pipeline welding, coati
29、ng, pressure test, blowing, drying, trench excavation / backfilling, cathodic protection, piling, hydraulic protection, pipeline undercrossing and concealed works.工程具备竣工验收条件，承包人按国家工程竣工验收有关规定，向发包人提供完整竣工资料及竣工验收报告。承包人应当在竣工前一周内提供3套竣工图。 When the Project meets the conditions for the inspection for complet
30、ion, the Contractor shall present the Owner the full set of materials on the Projects completion and the report for inspection for completion in accordance with the State regulations with respect to inspection for completion of project. The Contractor must provide 3 sets of as-built drawings within
31、one week before the completion of the Project.五、工程量确认和竣工结算 confirmation of quantity承包人每月25日向监理工程师提交已完工程量报告，由发包人和监理工程师对工程量报告予以审核确认。Contractor will on 25th each month summit supervision engineer with Report of Complete Quantity which is for the examination and confirmation of employer and supervision
32、engineer.工程竣工验收报告生效之日起7天内，承包人向发包人递交竣工结算报告及完整的结算资料，双方按照协议书约定的合同价款及专用条款约定的合同价款调整内容，进行工程竣工结算。The Contractor shall submit to the Owner a completion settlement report and a full set of settlement materials within 7 days after the report on inspection for completioncomes into effect. 33、e settlement process by adjusting the Contract Price according to agreed Contract Price and adjustment conditions. 六、合同价款与支付 Contract Cost and Payment6.1 甲、乙双方正式签约后，甲方需在_日之内支付工程造价总额的_给乙方。如甲方未按合同付款，则工期自然推后。当乙方收到甲方预付款后，_日内正式进入安装工地。Party A should, within _ days subsequence to formal signature of contra

Payment: by bank transfer, draft or cash 七、违约处理 Breach Settlement除本合同其他条款另有规定外，如果一方（“违约方”）未履行其在本合同项下某项主要义务，则对方（“受损害方”）除享有有关法律赋予的权利外，还可向违约方发出书面通知，说明违约的性质以及范围，并且要求违约方在通知中规定的合理期限内自费予以补救。Except as otherwise provided her

42、管道石油沥青及环氧煤沥青涂料外防腐层，雨期、冬季施工应符合下列规定：The application of Petroleum bitumen and epoxy coal tar paint as anticorrosive coating of steel piping in rainy days and/or winter season shall adopt the following regulations:2. 钢管加工 Pipe Process2.1 钢管切割Steel pipe cutting（1）镀锌钢管和公称通径小于或等于50mm的碳素钢管，一般宜用切管机切割；It is r
43、ecommended to cut galvanized steel pipe and carbon steel pipe with nominal diameter less or equal to 50 mm with pipe cutting machine;（2）SHA级管道和有淬硬性倾向的管子应用锯床、车床等机械方法切割；It is advised to cut pipes of grade SHA and of hardening capacity with mechanical methods including sawing machine or lather;（3）不锈钢管子
44、应用机械或等离子方法切割；It is recommended to cut stainless steel pipe with mechanical or plasma methods.（4）其他钢管可用氧乙炔焰切割。Other steel pipes can be cut with oxygen and acetylene.2.2 坡口加工Groove machining（1）SHA级管道和有淬硬性倾向的管子必须用机械方法加工。Only mechanical method is allowed to machine pipes of grade SHA and of hardening ca
45、pacity;（2）SHB级管道的管子宜用机械方法加工，亦可采用氧乙炔焰加工，但必须将其表面打磨平整。It is recommended to machine pipes of SHB I with mechanical method or oxygen & acetylene. The surface must be ground and polished.（3）中合金钢、不锈钢管子可用机械方法加工。用等离子方法切割时，应彻底修磨其表面。不锈钢管用砂轮切割或修磨时，应用专用砂轮片，严禁与碳钢管共用。Use mechanical method to machine intermediate a
